Hong Kong and Macao: EU publishes annual report on political and economic developments

The European Commission and the High Representative have today adopted their latest annual reports on political and economic developments in the Hong Kong Special Administrative Region and in the Macao Special Administrative Region during the year 2022.

The annual report on political and economic developments in the Hong Kong Special Administrative Region illustrates the continued erosion of Hong Kong's high degree of autonomy, democratic principles, and fundamental freedoms that were supposed to be protected until at least 2047. These developments cast further doubt on China's commitment to the “one country, two systems” principle. In 2022, the EU was Hong Kong's third-largest trading partner in goods.

The annual report on political and economic developments in the Macao Special Administrative Region shows a growing focus on national security that bears the risk of undermining fundamental freedoms in Macao and eroding the “one country, two systems” principle and Macao's high degree of autonomy. In the first 11 months of 2022, the EU overtook mainland China to become Macao's largest trading partner in goods.

Agriculture : la Commission approuve « Vaca de Extremadura » d'Espagne comme nouvelle indication géographique

Aujourd'hui la Commission a approuvé comme nouvelle indication géographique protégée (IGP) la « Vaca de Extremadura » d'Espagne.

Cette viande est issue des principales races d'élevage de bétail bovin existant en Estrémadure, au sud-ouest de l'Espagne. Les races couvertes par l'IGP « Vaca de Extremadura » sont parfaitement adaptées aux conditions de température et de pluviométrie extrêmes de la région, car elles sont capables de résister au froid comme à la chaleur, ainsi qu'à la pénurie d'eau pendant les périodes de sécheresse. La qualité du produit de l'IGP « Vaca de Extremadura » se fonde sur le système de production selon le régime extensif de la dehesa et des pâturages de ce type, permettant d'atteindre des taux élevés en matière de bien-être animal. En effet, le niveau de stress au cours de la production est beaucoup plus bas et les durées d'allaitement sont généralement respectées. Cette situation confère au produit des caractéristiques qui lui sont propres.

Cette nouvelle dénomination sera ajoutée à la liste des 1 650 produits agricoles déjà protégées. Mergers: Commission to assess the proposed acquisition of Autotalks by Qualcomm

The European Commission has accepted the requests submitted by 15 EU Member States to assess the proposed acquisition of Autotalks by Qualcomm under the EU Merger Regulation (‘EUMR').

These referral requests reached the Commission after it had invited Member States to make a referral request. Qualcomm is a global US-based semiconductor manufacturer serving various industries, including the automotive sector where its chipsets enable vehicles to communicate directly with each other and with their surrounding environment (vehicles-to-everything (‘V2X') communications). Autotalks is an Israeli semiconductor manufacturer specialized in V2X semiconductors.

The proposed acquisition does not reach the notification thresholds set out in the EUMR, and it was not notifiable in any Member State. Belgium, France, Italy, the Netherlands, Poland, Spain and Sweden submitted initial referral requests to the Commission pursuant to Article 22(1) of the EUMR. This provision allows Member States to request the Commission to examine a merger that does not have an EU dimension but affects trade within the single market and threatens to significantly affect competition within the territory of the Member States making the request. Other countries of the European Economic Area (‘EEA') had the opportunity to join the original referral requests. Subsequently, Czechia, Denmark, Finland, Ireland, Luxembourg, Portugal, Romania and Slovakia joined the initial referral requests.

On the basis of the information available to the Commission at this early stage, and without prejudice to the outcome of its full investigation, the Commission considers that the transaction meets the criteria for referral under Article 22 of the EUMR. In particular, the transaction would combine two of the main suppliers of V2X semiconductors in the EEA. The V2X technology is key to improving road safety, traffic management and reducing CO2 emissions as well as for the deployment of autonomous vehicles. It is therefore important to ensure that customers such as original equipment manufacturers or infrastructure managers retain access to V2X technology at competitive prices and conditions. The Commission has asked Qualcomm to notify the transaction. Qualcomm cannot implement the transaction before notifying and obtaining clearance from the Commission.

This is the second occasion on which the Commission has accepted referral requests under Article 22(1) of the EUMR in application of its Article 22 Guidance adopted on 26 March 2021.

Mergers: Commission clears acquisition of BPS by Advent and Warburg Pincus

The European Commission has approved, under the EU Merger Regulation, the acquisition of joint control of Baxter Pharmaceutical Solutions LLC of the US and Baxter Oncology GmbH of Germany ('BPS') by Advent International Corporation and affiliated funds (‘Advent') and Warburg Pincus LLC and affiliated funds (‘Warburg Pincus'), both of the US.

BPS provides contract development and manufacturing organization services for finished dose pharmaceuticals. Advent is a private equity investor focusing on the acquisition of equity stakes and the management of investment funds in various sectors, including healthcare. Warburg Pincus is a global private equity firm active in a variety of sectors, including healthcare.

The Commission concluded that the proposed acquisition would raise no competition concerns, given the companies' limited combined market position and the limited vertical relationships resulting from the proposed transaction. The transaction was examined under the simplified merger review procedure.

Journée mondiale de l'aide humanitaire 2023: déclaration du haut représentant/vice-président Josep Borrell et du commissaire à la gestion des crises Janez Lenarčič

À l'approche de la Journée mondiale de l'aide humanitaire, le vice-président de la Commission des droits de l'homme Josep Borrell, et le commissaire Janez Lenarčič ont publié une déclaration : « Partout dans le monde, de plus en plus de personnes sont plongées dans des crises humanitaires en raison de conflits nouveaux ou en cours et des conséquences de l'urgence climatique et écologique. Si les personnes ayant besoin d'une aide humanitaire formaient un pays, il s'agirait du troisième plus grand au monde. Et ce pays qui n'en est pas un mais qui souffre, croît à un rythme exponentiel - en hausse de 30 % depuis début 2022. Aujourd'hui plus que jamais, les populations touchées par les crises ont besoin d'une aide humanitaire.

C'est pourquoi, à l'approche de la Journée mondiale de l'aide humanitaire, nous rendons hommage aux travailleurs humanitaires qui, en première ligne, risquent leur vie pour sauver d'autres personnes et réduire la souffrance humaine, et nous honorons la mémoire de ceux qui ont péri au service d'autrui.

Depuis le début de l'année, les attaques contre les travailleurs humanitaires ont tragiquement entraîné la mort de 62 humanitaires, l'enlèvement de 33 autres et les blessures de 82 autres. Ces actes sont inacceptables et ne doivent pas être tolérés.

La protection des civils, notamment des travailleurs humanitaires, ainsi que du personnel médical, est une obligation en vertu du droit international humanitaire qui doit être respectée, y compris en ce qui concerne la garantie d'un accès sans entrave à l'aide humanitaire.

La guerre d'agression de la Russie contre l'Ukraine a provoqué une crise mondiale de l'énergie et de la sécurité alimentaire, entraînant une aggravation de la situation humanitaire dans le monde entier. Nous avons également assisté à l'éclatement de nouveaux conflits, tels que les combats dévastateurs au Soudan et les coups d'État militaires au Sahel, qui ont aggravé la situation humanitaire générale.

Pour ne rien arranger, la décision de la Russie de mettre fin à l'initiative sur les céréales de la mer Noire, suivie d'attaques accrues contre les ports ukrainiens de la mer Noire et du Danube, perturbant les livraisons de céréales dans le monde entier, plongera d'innombrables communautés dans l'insécurité alimentaire, comme en Afghanistan, à Djibouti, en Éthiopie, au Kenya, en Somalie, au Soudan ou au Yémen. »
